Welcome to Healthdial, a user-generated content (UGC) platform connecting users with nursing officers, hospitals, clinics, doctors, and online consultation services. These Terms of Service govern your use of our platform and outline the responsibilities of all parties involved.

Acceptance of Terms

By accessing or using the Healthdial website, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, please refrain from using our platform.

User-Generated Content (UGC) Platform

Healthdial operates as a user-generated content (UGC) platform under Section 79 of the Information Technology Act, 2000, connecting users with nursing officers, hospitals, clinics, doctors, pharmacies, diagnostic labs, and blood banks. Users are solely responsible for the accuracy, legality, and authenticity of content, including profiles, service descriptions, and pricing, submitted to the platform.

Healthdial does not warrant or verify the qualifications, credentials, or performance of listed providers. Users agree to indemnify and hold Healthdial harmless from any claims, disputes, or liabilities arising from interactions with healthcare providers or reliance on user-generated content. Healthdial disclaims all liability for any legal actions, losses, or damages resulting from such interactions, to the fullest extent permitted by law.

Intellectual Property Rights

All content created by Healthdial, such as the website design, logos, and proprietary text, is the property of Healthdial and protected by copyright laws. User-generated content belongs to the respective users who created it, but by submitting content to Healthdial, you grant us a non-exclusive, royalty-free license to display and distribute it on our platform. Users agree not to reproduce, distribute, or modify Healthdial’s proprietary content without express written consent.

Information Collection

We collect information as outlined in our Privacy Policy. Please review it to understand how we handle your data, including personal and location information, to provide location-based services.

User Responsibilities

Users are responsible for:

  • Maintaining the confidentiality of their login credentials and all actions taken under their account.
  • Ensuring the accuracy and legality of any content they submit, including profiles, qualifications, and service details.
  • Complying with all applicable laws and regulations when using Healthdial.

Nursing officers, hospitals, clinics, doctors, or other providers creating profiles must ensure their information is truthful and up-to-date. Healthdial is not responsible for verifying this information or resolving disputes arising from inaccuracies.

Doctor Responsibilities and Terms

Doctors utilizing Healthdial to create profiles or provide consultation services agree to the following:

  • Accurate Information: Warrant the accuracy and currency of qualifications, specialties, education, license numbers, and consultation modes (online, in-person, or both), as required under the Indian Medical Council Act, 1956.
  • Verification: Submit valid license numbers and credentials for verification. Healthdial may designate profiles as "verified" or "pending," but disclaims liability for inaccuracies.
  • Consultation Services: Fulfill fiduciary duties by providing timely and professional consultation services, clearly disclosing availability and pricing in profiles.
  • Premium Accounts: Adhere to additional visibility and service obligations for premium accounts as specified during account setup.
  • Compliance: Comply with medical ethics, applicable healthcare regulations, and platform policies. Breaches, including misuse of patient data, may result in account suspension or termination.

Healthdial shall not be liable for disputes arising from consultation services, including pricing, quality, or outcomes. Users must independently verify doctor credentials prior to engagement.

Pharmacy Responsibilities and Terms

Pharmacies listed on Healthdial agree to the following:

  • Valid Credentials: Provide accurate license numbers, GST numbers, and contact details, ensuring regulatory compliance with the Drugs and Cosmetics Act, 1940.
  • Inventory Accuracy: Warrant the accuracy and regular updating of listed products and services, including delivery availability.
  • Delivery Terms: Clearly disclose delivery areas, timelines, and costs. Healthdial disclaims liability for delivery-related disputes.
  • Payment Methods: Transparently disclose accepted payment methods and adhere to fair pricing practices.
  • Compliance: Comply with all applicable laws governing the sale and distribution of medications.

Healthdial does not regulate or verify pharmacy inventory or pricing. Users shall verify pharmacy credentials and terms before placing orders.

Labs and Diagnostics Responsibilities and Terms

Diagnostic centers and labs listed on Healthdial agree to the following:

  • Valid Certifications: Provide accurate license numbers, certifications, and contact details, ensuring compliance with applicable diagnostic and healthcare regulations.
  • Test Accuracy: Warrant the accuracy and currency of listed test types and services. Healthdial disclaims liability for inaccurate results or delays.
  • Home Collection: Clearly disclose home collection availability, service areas, and costs. Users must confirm these details prior to booking.
  • Result Delivery: Deliver test results within promised timeframes and uphold confidentiality obligations as per our Privacy Policy and applicable laws.
  • Payment Terms: Transparently disclose accepted payment methods and pricing for all services.

Healthdial shall not be liable for disputes related to test results, delays, or pricing. Users must verify lab credentials and service terms before booking.

Blood Bank Responsibilities and Terms

Blood banks listed on Healthdial agree to the following:

  • Accurate Information: Warrant the accuracy of blood group availability, storage capacity, license numbers, and certifications, as required under applicable blood safety regulations.
  • Donation Process: Clearly disclose the blood donation process, eligibility criteria, and any associated costs. Healthdial disclaims liability for donation-related disputes.
  • Emergency Services: Ensure availability and responsiveness for 24x7 services or emergency contacts as advertised.
  • Compliance: Fulfill statutory obligations governing blood collection, storage, and distribution.
  • Data Protection: Uphold confidentiality of donor data as per our Privacy Policy and applicable laws.

Healthdial does not verify blood group availability or storage conditions. Users shall confirm details with blood banks before proceeding.

Use of Services

Healthdial is a platform for connecting users with healthcare providers for informational and communication purposes. Users agree not to misuse the platform for unlawful activities, including impersonation, fraud, or posting misleading content.

Location Access

Healthdial may collect your device’s location data to provide location-based search results (e.g., nearby nursing officers or clinics). By using our platform, you consent to this data collection as described in our Privacy Policy.

Modification of Terms

We may update these Terms of Service at any time. Continued use of Healthdial after changes constitutes acceptance of the modified terms. Check this page periodically for updates.

Account Creation

Any user can create an account or profile on Healthdial. We do not pre-approve or verify accounts for nursing officers, hospitals, clinics, or doctors. Users are solely responsible for the authenticity and accuracy of their profiles. We reserve the right to suspend or terminate accounts that violate our terms or appear suspicious, at our discretion.

Verification Process

Healthdial may conduct due diligence to verify credentials of doctors, pharmacies, diagnostic labs, and blood banks using submitted license numbers, certifications, or other documents, as per applicable regulations, including the Drugs and Cosmetics Act, 1940. Profiles may be designated as "verified," "pending," or "failed" based on this process. However, such verification does not constitute a warranty or endorsement of service quality or accuracy. Users shall independently verify provider credentials and assume all risks associated with engaging services.

Chat Terms

Healthdial provides a chat feature for professional communication between users and healthcare providers. We are not responsible for the content of messages, including abusive or inappropriate interactions. All chat interactions may be monitored for security and compliance purposes. Violations of our terms or Privacy Policy may result in account termination. Users should report inappropriate behavior to us promptly.

Termination

We may suspend or terminate access to Healthdial at our discretion, without notice, for reasons including but not limited to violations of these terms, suspicious activity, or legal requirements.

Pricing and Charges

Healthdial does not regulate, control, or assume responsibility for the pricing, fees, or charges set by nursing officers, hospitals, clinics, doctors, pharmacies, diagnostic labs, or blood banks. All pricing constitutes a contractual obligation solely between the user and the respective provider. Healthdial shall not be liable for any disputes, claims, or losses arising from pricing, including but not limited to consultation fees, product costs, diagnostic test charges, or blood donation fees, pursuant to applicable laws.

Feedback and Communication

We welcome feedback to improve Healthdial. Submit feedback via our Contact Us page. We may use your feedback to enhance our platform but reserve the right to disregard abusive or unlawful submissions.

Data Accuracy and Privacy

We strive to protect your data as outlined in our Privacy Policy. However, as a UGC platform, we do not guarantee the accuracy of user-submitted content. Users can update their own information via account settings or by contacting us.

Third-Party Links

Healthdial may include links to third-party websites. We are not responsible for their content, privacy practices, or any resulting damages or losses.

Limitation of Liability

Healthdial serves as an intermediary platform facilitating connections between users and healthcare providers, including nursing officers, hospitals, clinics, doctors, pharmacies, diagnostic labs, and blood banks, without providing healthcare services itself. Pursuant to the Indian Contract Act, 1872, Healthdial does not verify or warrant the credentials, qualifications, or performance of providers. All liability for healthcare services, errors, omissions, negligence, or breaches lies solely with the providers and users. Healthdial disclaims all responsibility for any direct, indirect, incidental, or consequential damages arising from platform interactions, to the maximum extent permitted under Indian law.

Healthdial Tools

Healthdial offers free health tools (e.g., BMI Calculator, Water Intake Calculator, Fitness Goals Planner) to support your wellness journey. By using these tools, you agree to the following terms, in addition to the general Terms of Service above.

Tool Usage:

  • Tools are for adults (18+). Do not use them for children or others without proper guidance.
  • Tools provide general wellness tips, not medical advice. Consult a doctor via Healthdial for health concerns.
  • Use tools only for personal purposes. Do not automate, scrape, or misuse tool results.

Accuracy and Responsibility:

  • Tool results depend on the information you enter. Healthdial is not responsible for inaccurate inputs or results.
  • We aim to keep tools reliable but cannot guarantee accuracy. Use them at your own risk.
  • You are responsible for how you use tool results. Always seek professional advice for medical needs.

Liability:

  • Healthdial is not liable for any harm, decisions, or consequences from using tool results.
  • Tools are provided “as is” and may be updated or removed without notice.

Consent: Using our tools means you agree to these terms and our Privacy Policy. Stop using the tools if you do not agree.

Dispute Resolution

Any disputes arising from the use of Healthdial or interactions with healthcare providers, including doctors, pharmacies, labs, and blood banks, shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in India, and the proceedings shall be in English. The courts of India shall have exclusive jurisdiction over any legal proceedings.
